PHILADELPHIA, PA – The family of Kishan Patel, a 30-year-old Voorhees, N.J. man who was seriously brain injured and rendered quadriplegic after being shot by an off-duty NYPD officer during a road-rage incident on May 17, will announce tomorrow that they have filed a lawsuit against the city of New York, Mayor Eric Adams, and Hieu Tran, the 27-year-old NYPD officer charged in the shooting.
Mr. Patel’s family and attorney Joseph M. Marrone will address media tomorrow at 11:30 a.m. outside the Southern District Courthouse, 500 Pearl Street, New York, 10007.
According to the complaint, Mr. Patel was leaving work and was driving home in Voorhees, N.J. at approximately 11:15 p.m. on May 17 of this year when NYPD Officer Hieu Tran allegedly pulled alongside him at a red light at the intersection of Route 73 and Cooper Road. Using his department-issued firearm, Officer Tran fired several shots into Mr. Patel’s car, striking him in the back of the head. Mr. Patel’s vehicle then drove into the intersection where he struck another car, seriously injuring the female driver.
After an investigation, NYPD Officer Tran was arrested June 6 and charged with attempted murder, aggravated assault, and possession of a weapon for an unlawful purpose. He is currently being held in Camden County.
Mr. Patel suffered numerous injuries including cardiac arrest that resulted in an anoxic brain injury, as well a broken vertebra at the C1-C2 level. Mr. Patel currently has limited brain function and is being transferred to a facility in Texas where he can receive specialized treatment.
According to the complaint, prosecutors argued during a bail hearing that their psychiatrist expert noted that NYPD Officer Tran “is a young police officer suffering from untreated work-related PTSD,” with prosecutors alleging that Tran had been self-medicating with alcohol for years. Judge Michael Joyce of the New Jersey Superior Court denied Tran bail.
A copy of the complaint, which was filed in the United States District Court in the Southern District of New York, is attached.
